These Terms & Conditions (“Terms”) govern the use of the Gotcha Fresh Tea (“Gotcha”) website, the purchase of products online, the Gotcha Club, both mobile and web applications (“the App”), and the participation in Gotcha Fresh Tea promotions and campaigns. By accessing our website, app, purchasing our products, or taking part in our promotions, you agree to be bound by these Terms.

BABYMONSTER Concert Ticket Giveaway Terms and Conditions

Eligible entrants: Entry is open to Australian and New Zealand residents over 18 years of age. Employees of Promoter, their respective agents, parents, affiliated or related companies, subsidiaries, as well as their immediate families are not eligible to enter the Competition.

Entries permitted: Multiple entries are permitted. Each entry must be submitted as a separate post or story. Entries that do not comply with these requirements will be deemed invalid.

Campaign Period: The giveaway commences on 29 October at 10:00 AM AEST and concludes at 11:59 PM AEST on 15 November. Entries submitted outside of this promotional period will not be accepted.

The Prize: There will be a total of six (6) winners, three (3) for the Melbourne tour and three (3) for the Sydney tour. Each winner will receive two (2) x B Reserve concert tickets to the BABYMONSTER WORLD TOUR [춤 (CHOOM)] IN MELBOURNE OR SYDNEY, in their selected city. Each winner will also receive two (2) x Gotcha $25 Drink Vouchers.

General Prize Conditions:

The Winner is only entitled to the relevant Prize as outlined above and are not entitled to any additional prizing or cash reimbursement to compensate for any difference in actual Prize redemption cost and maximum value. No Prize is transferable nor can any Prize be taken as cash. No compensation is payable if the Winner cannot receive any aspect of the Prize for any reason.

Concert tickets are strictly non-transferable and cannot be resold, exchanged, or redeemed for cash. The winner's legal name must match the concert ticket at the venue, and valid photo ID may be required for entry. Any concert tickets found to be resold or on-sold will be instantly cancelled, voided, and will not be reissued.

The Gotcha drink vouchers will be issued exclusively through the official Gotcha Loyalty App. Winners must download the app and create an account to redeem their drink prizes. Each drink voucher is valid for one-time use only, is not transferable, exchangeable, refundable, or redeemable for cash, and cannot be used in conjunction with any other voucher, promotion, discount, or in-store offer.

Transportation to and from an event and all other ancillary costs relating to redemption of the Prize (including flights, accommodation, and parking) are the responsibility of the winner (at the winner’s sole cost and expense).

All additional costs not expressly stated herein but incurred in acceptance and use of the relevant Prize is the sole responsibility of the Winner and will NOT be the responsibility of the Promoter.

Should any elements of the prize be changed, moved, cancelled or not available for any unforeseen reason or for reasons outside of the Promoter’s control (including for example COVID-19), the Promoter takes no responsibility, and the Prize Winners will not be compensated.

If for some reason beyond Promoter’s control, it is not possible to supply the Prize as advertised, Promoter will be entitled to supply a substitute prize in Promoter’s discretion. If the Competition is not capable of running as planned due to any reason (including, but not limited to fraud, a state of emergency, natural disaster, war, technical failures or any other causes), Promoter reserves the right without liability to the entrants to cancel, modify, terminate or suspend the Competition.

Promoter’s decision in relation to any aspect of the Competition is final and binding on every person who enters, and no correspondence will be entered into.

By entering this Promotion, the entrants and participants automatically agree to accept and abide by these Rules. All decisions of the Promoter with respect to any aspect of this Promotion, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Promotion.

Judging & Winner Selection:

This is a game of skill and chance plays no part in determining the winners. All valid entries will be individually judged by the Promoter's marketing team based on creativity, originality, overall aesthetics, and the best representation of the BABYMONSTER vibe or incorporation of BABYMONSTER WORLD TOUR elements, or K-pop vibe.

The number of winning entries to be selected will be the same as the total number of Prizes as specified in the Prize section of the terms.

Winners will be announced and contacted via Instagram Direct Message (DM) from the official @gotchafreshtea account between 20 November and 27 November.

Winners must reply within 24 hours with their full legal name, email address, and phone number to claim the prize. Failure to respond within this timeframe will result in the prize being forfeited, and an alternate winner being selected based on the judging criteria. The Promoter’s decision will be final and binding. Each winner will receive a Prize.

General Terms:

Winner may not transfer the Prize to another individual and Prize may not be sold or converted into cash.

The named individual Winner must be the individual that proceeds with the Prize.

Entries containing phone numbers, personal addresses (physical or email), Web site URLs, derogatory characterisations of any ethnic, racial, sexual or religious groups, references to illegal or inappropriate activity, behaviour or conduct, or any other references that could be considered inappropriate, unsuitable or offensive, as determined by Promoter, in its sole discretion, are prohibited. Promoter may delete any entries it deems offensive or inappropriate in its discretion and such entries will be disqualified from the Competition.

The Entry will become the property of Promoter and each entrant hereby grants Gotcha Fresh Tea a royalty-free, non-exclusive right to share, repost, and feature their submitted images/videos on the official @gotchafreshtea Instagram account and other marketing channels. The entrant assigns, including as a present assignment of future copyright, any right, title and interest (including copyright) the entrant may have in the Entry to Promoter worldwide and in perpetuity. Each entrant acknowledges that Promoter may use the Entry and materials and any intellectual property rights subsisting in the Entry in any medium and in any manner it sees fit, including without limitation, by reproducing, modifying or adapting such entries, free from any claim whatsoever in any country or place in the world. Each entrant further consents to any and all acts or omissions of Promoter which would, but for this consent, infringe any of the entrant’s moral rights or similar rights in the Entry.

Where, under Australian consumer laws, there are any warranties and conditions that cannot be excluded, restricted or modified or can only be excluded, restricted or modified to a limited extent, Promoter excludes all warranties and conditions to the extent allowable by these laws. Promoter accepts no liability or responsibility of any kind for any defect with the Prize nor for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) which is suffered or sustained in connection with the Competition or the Prize in any way to the fullest extent allowable by law.

Promoter is not responsible for any misdirected, late or incomprehensible entries in the Competition. Promoter is not responsible for any problems or technical malfunctions of any telephone network, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading or uploading any materials in this Competition.

Promoter is not responsible for any tax implications that may arise from winning a Prize. Entrants should seek independent financial advice about such matters.

The Promoter in its absolute discretion reserves the right to verify the validity of all entries and to disqualify entrants if they tamper with the entry process including but not limited to submission of an entry not in accordance with these terms and conditions or where Promoter reasonably believes that an entrant has acted in bad faith in respect of the Competition.

This Competition is in no way sponsored, endorsed or administered by or associated with Instagram. Entrant information disclosed as part of the Competition is disclosed to Promoter and not to Instagram. Each entrant fully releases Instagram from any loss or liability suffered by the entrant in connection with the Competition.

In the event of any discrepancy or inconsistency between the terms and conditions of the Rules and disclosures or other statements contained in any Promotion related materials, including but not limited to the Promotion entry form, the terms and conditions of the Rules shall prevail, govern and control.

All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Promoter and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

Gotcha Club Loyalty Program

1. Membership and Eligibility

Gotcha Club is a loyalty program operated by Gotcha Fresh Tea, available at participating stores and through the official Gotcha Club mobile app and web app.
Gotcha Club members (“Member”) must register for a Gotcha Club account (“Account”) to access the program’s benefits, including earning and redeeming Gotcha Dollars (“Loyalty Points”), membership rewards and exclusive offers.
Accounts are intended for personal use and must not be shared, transferred or used to obtain multiple registration or promotional benefits.

2. Earning Gotcha Dollars

Members earn Gotcha Dollars at the point of purchase made directly at participating Gotcha Fresh Tea stores or through the official Gotcha Club mobile and web app.
Members will receive 1 Gotcha Dollar for every AUD $10 spent in a single transaction.
Members may earn Gotcha Dollars based on their membership tier, with reward rates ranging from 6% to 12% of eligible spending.
Purchases made using discounts, promotional vouchers, or special offers are not eligible to earn Gotcha Dollars, unless otherwise specified.
Gotcha Dollars accumulate in your Gotcha Club account and can later be redeemed toward future purchases.
Purchases made via third-party platforms, including but not limited to Uber Eats, Hungry Panda, DoorDash or other delivery or cashback services, are not eligible to earn loyalty points.
Purchases that are cancelled, refunded, or not accepted by the store, including transactions where payment was processed but the order was not fulfilled, are not eligible to earn Gotcha Dollars.
Earned Gotcha Dollars will be credited to the Member’s account and may take up to twenty-four (24) hours to appear. Members should contact Gotcha through the official Contact Us channel if their rewards remain missing after this period.

3. Existing Member Account

Eligible Gotcha Dollars balances held under the previous Gotcha Perks loyalty program will be carried over to the Gotcha Club system.
Members may view their transferred Gotcha Dollars balance through their Gotcha Club Account.
Members experiencing issues with their transferred balance may contact Gotcha through the official Contact Us channel.

4. Redeeming Gotcha Dollars

Gotcha Dollars may be redeemed toward eligible orders, depending on your available balance.
The minimum redemption value is AUD $0.10.
Gotcha Dollars used in a redemption transaction do not earn additional points for that purchase.
Certain promotional products, limited-edition items, merchandise or special offers may be excluded from Gotcha Dollars redemption.
Gotcha Dollars are non-transferable, cannot be exchanged for cash and have no monetary value outside the Gotcha Club loyalty program.

5. Discounts & Vouchers

Members may occasionally receive discounts or vouchers as part of special promotions or campaigns.
To be eligible to receive the vouchers, the member must be registered at least 2 days prior to the promotion end date listed on posters and/ descriptions.
Transactions where a discount or voucher is applied will not earn Gotcha Dollars.
Discounts or vouchers cannot be used in conjunction with other discounts, promotions, or third-party platforms.
Each promotion may be subject to specific eligibility requirements, validity periods, participating store restrictions and product exclusions.
Gotcha Fresh Tea reserves the right to amend or cancel discounts and/or vouchers at any time without prior notice.

6. Order Ahead, Cancellations & Refunds

Members may place orders for collection at participating Gotcha Fresh Tea stores through the Gotcha club mobile app or web app.
Members are responsible for selecting the correct store, products, and customisation options before confirming their order. Order availability and preparation times may vary by location.
Where a refund is applicable, processing may take approximately seven (7) to fourteen (14) business days. Actual timeframes may vary depending on the payment provider, payment terminal and the Member’s financial institution.
Cancelled drink orders, refunded, or not accepted by the store, including transactions where payment was processed but the order was not fulfilled, will not qualify for loyalty points accrual.

All offers, promotions, and rewards under the Gotcha Club Loyalty Program are subject to availability and may vary by store location. Where there are reasonable grounds to believe that a Member has breached these Terms & Conditions, Gotcha Fresh Tea may suspend or restrict access to the account while the matter is investigated. Gotcha Fresh Tea reserves the right to modify, suspend, or terminate the program, or any of its associated offers, at any time without prior notice.

Sip More Get More Stamp Collection Card

Offer valid only at participating stores listed on the card.
Not valid with LIVEN or ShopBack payments.
Not valid in conjunction with other promotions or discounts.

Vouchers

Vouchers (digital or print) issued by Gotcha Fresh Tea are valid only at participating stores.
Each voucher is valid until the expiry date specified.
Vouchers cannot be redeemed for cash or combined with other promotions/discounts.
Only one voucher may be applied per order.
Gotcha Fresh Tea reserves the right to make the final decision on voucher use.

2026 Valentine Special Voucher

Valentine Special buy one get one free vouchers will be issued to eligible Gotcha Perks members on 12 February 2026.
Members who sign up to the Gotcha Perks Loyalty Program on or before 12 February 2026 will automatically receive the promotional voucher in the Rewards section of the Gotcha Perks app.
Members who register on or after 15 February 2026 will not be eligible to receive the Valentine Special promotional voucher.
The voucher is valid until 15 February 2026.
The voucher is non-transferable, not redeemable for cash, and cannot be used with other offers unless stated otherwise.

The promotion is available on a first come, first served basis and is subject to availability.
The free bubble tea cannot be exchanged for cash or any other product, voucher or offer.
The promotion cannot be used in conjunction with other promotions, discounts or offers unless otherwise stated.

Participation in Gotcha Fresh Tea social media campaigns (e.g., giveaways, contests, promotions) constitutes acceptance of these Terms.
Winners will be contacted only via Gotcha Fresh Tea’s official accounts (IG: @gotchafreshtea ; FB: gotchafreshtea) based on eligibility criteria outlined in the campaign post.
Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash.

Return & Exchange Policy

Products purchased from our website may be eligible for return or exchange within 14 days, provided they are in original condition and pass our quality check.
Shipping costs for returns and exchanges are the responsibility of the customer, unless the product is faulty or damaged on arrival.
